OROP PAYMENT CLARIFICATIONS & RANKS IN THREE SERVICES

   There have been numerous doubts on the payment of OROP which have been clarified by the PCDA in its circular Number 557 dt 17 Mar 2016. Salient features as applicable to the  three services are as given below:-

OROP PRINCIPLE .As per Govt. letter No. 12(1)/2014/D(Pen/Policy) Part-II dated 07.11.2015 OROP implies that uniform pension to be paid to the Defence Forces Personnel retiring in the same rank with the same length of service, regardless of their date of Retirement.”  The pension of all past pensioners will be determined according to the above principle.

RANK WEIGHTAGE In Post-2006 retirees cases, weightage had been withdrawn from Qualifying Service. Therefore, the qualifying service mentioned in OROP table is actual qualifying service only. No weightage in qualifying service is to be allowed at all while extending the benefit of OROP in past cases. For example, if actual Q.S. was ‘q’ years and weightage, if any, was ‘y’ years, the pension indicated in the concerned table for ‘q’ years only is to be paid to the pensioner. (Please Note - The OROP



  OROP Scheme is aimed to bring Pre and Post – 2006 retirees at par where in the Rank weightage has been done away with. Post 2006 retirees get the 50% of last pay drawn which is more than the earst while full pension which has been 50% of the Minimum Pay in Pay Band of the Rank.   The rank weightage compensated for the early retirement which is forced upon Mil Pers by the Govt so that with their retirement age as per rank they get so called full pension which has been the 50% 0f the "Minimum Pay in the Pay Band" with no regards to your length of service and the increments.)

MAJORS GETTING LT COL'S PENSION , All substantive Majors retired on or after 1.1.1996 but before 01.01.2006, who had completed 21 years of commissioned service and were granted pay of Lt. Col. as per Para 5(a) (iii) and 5 (a) (iv) of Special Army Instruction 2/S/98. Such Majors have been allowed the benefit of revision of pension as per rates of Lt. Col. under 6th CPC on the authority of GoI, MoD Deptt. of Ex-Service Welfare letter No. 1(13)/2009/D(Pen/Policy) dated 24th sept 2012. In these cases, Corr PPO’s have been issued by concerned PSAs revising pension under 6th CPC. Pension of such Majors may also be revised as per the table applicable to Lt. Col. However, in case of any doubt, the case may please be referred to PSAs concerned for  clarification.

PAYMENT OF ARREARS - Arrears on account of revision of pension and LTA from 1.7.2014 to 02.03.2016 shall be paid by the Pension Disbursing Agencies in four equal half-yearly instalments and not in lumpsum. However, all the family pensioners including those in receipt of Special/Liberalized Family Pension and all  gallantry award winners shall be paid arrears in one instalment as per Para 17 of the Circular No. 555 dated 04.02.2016.

ACP PENSIONS   In case ACP is granted, pension of next higher rank will be admissible to the pensioner. In case of Subedar Major who got ACP-I, pension may be revised for Hony. Lt.  But it is not likely that ACP-II is granted to a Subedar Major, so if any case of Subedar Major with  ACP-II comes into the knowledge, the same is to be forwarded for clarification to PCDA (P).


AS PER CIRCULAR 557 DT 17 MAR 2016

The rank of Lt. Gen (HAG+) was introduced after 01.01.2006. Hence, rank of Lt. Gen (HAG+) is found only in Post-01.01.2006 cases. In such cases, pay scale for that rank i.e. Rs. 75500-80000 is mentioned in the PPO. For Pre-2006 cases, pension of HAG will be payable to retired Lt. Generals, unless retired in the rank of Army Commander or equivalent. Same applies to equivalent ranks in Air Force and Navy.




7TH CPC AWARD   Rumours have been dotting the social media that the award of 7th CPC will not be given to Def Pensioners since they have been given enhanced pension under the OROP Scheme. It is  clarified that these are only rumours. By the OROP principle as given above all past pensioners who retired before 01 Jan 2014 have been brought at par which also includes pensioners of 6th CPC. Please note that in case CPC award is denied it will amount to discrimination within a class. We are therefore of the firm view that there being just one category of PRE- Jan 2016 retirees now, the 7th CPC award has to be applicable to all.

    THE DATE MENTIONED AS O1 JAN 2014 IS CORRECT, WHEN WE MENTION THAT ALL THOSE WHO RETIRED BEFORE 2013 HAVE BEEN BROUGHT AT PAR BY THE OROP SCHEME (BASE YEAR BEING 2013) WHERE AS THOSE RETIRED ON OR AFTER 01 JAN 2014 TILL 31 DEC 2016 HAVE NOT BEEN UNDER THE EQUILISATION PROCESS OF THE ORO SCHEME.
    HENCE I HAVE BROADLY TERMED ALL RETIREES WHO WILL REAP THE BENEFITS OF 7 CPC AS ON 01 JAN 2016, UNDER ONE BROAD CATEGORY SAY PRE - 2016.

    I have retired voluntarily on 31 Aug 1996 as a Group X JWO after completing 21 years of service in IAF.My OROP payment is fixed at Rs 10480/-. Kindly let me know what would be the difference in my basic pension as per the new fitment table and from which year onwards this will be applicable?. Regards

  4. Payment of arrears. Period is wrongly given in circular 557 as 1.7.14 to 2.3.16(latter date is wrong, it shd be 3.2.16 - 3rd Feb and not 2nd Mar!! All veterans shd be getting new pension from 4.2.16 ie Feb pension from this DT. Pcda pensions needs to amend it and info all banks!!!

    31 AUG 2014 WITH BASIC PENSION ie.SERVICE ELEMENT OF Rs.33375/-AND DISABILITY ELEMENT FOR 30% DISABILITY Rs.6008/- WITH QUALIFYING SERVICE OF 35 YEARS 05 MONTHS 17 DAYS (INCLUDING ORs SERVICE 10 YEARS 86 DAYS). AS PER OROP TABLE FOR LT COLONEL WITH SAME QUALIFYING SERVICE, THE BASIC SERVICE ELEMENT PENSION IS Rs.34765/- AND DISABILITY WITH 30% DISABILITY PENSION IS Rs.6258/- FOR PRE 01 JULY 2014 RETIREES. THEREBY POSING AS PRE JULY 2014 RETIREES WILL GET MORE BASIC THAN RETIREES POST 01 JULY 2014 TILL 31 DEC 2016. REQUEST EDUCATE PLEASE. THANKS PLEASE.

  6. Dear Col Onkar,
    1. You are right in your observation. Since you retired during the currency of 6 CPC your pension fixation is actual as per your last salary/emoluments based on the number of increments your got so mentioned clearly in your PPO. Where as, for pre-2014 retirees it is notional fixation on taking averages of offrs' pensions, of the same rank retired in the year 2013 with equal service under the OROP scheme. What I can guess is that you did not remain in your present rank for long before retirement.
    2. I have seen this in many cases, rather one of my own officer who retired like you in Nov 2014 in my rank is getting nearly Rs 2000 more in Pension than my OROP fixation. He got many more incrementsbefore retirement.
    3. You will again have similar situation when 7th CPC is implemented Your pension will be determined on the min of fitment table multiplied by the 7-CPC factor plus the number of increments you received as a Lt Col @ 3% per increment.

Sir I am ex/Sgt Biswajit De retired fm Air Force on 28feb1992.I held sgt rank for 2 months and granted pension for the rank of Col.But I found out fm PCDA Circular 397 and 551 that minimum 10 months rank service for pension of that rank has been dispensed with and pension will be sanctioned for the rank held in the last day of the service. Now my query is whether I am eligible for Sgt pension or not based on the above mentioned PCDA Circulars. Thank you sir for your great services to the Fuji community
