OROP IMPLEMENTATION INSTRUCTIONS

         The implementation instructions have also been issues within 24 hrs of the issue of the MOD (DESW) Letter of 03 Feb 2016 vide PCDA(P) Circular Number 555 dated 04 Feb2016 to the Banks and other Pension Disbursement Agencies (PDAs). The Circular can be viewed / downloaded from their web site by opening the URL as under :-

       The circular also has the MOD letter as an attachment to it. The circular gives comprehensive instructions to the PDAs to check the rank groups qualifying service of the pensioners from their PPOs and then pay as per the relevant tables as explained there. IT HAS BEEN HOWEVER ALLEGED THAT CERTAIN CONDITIONS WHICH ARE NOT THERE IN THE GOVT LETTER HAVE BEEN IMPOSED BY PCDA ON ITS OWN THERE BY DENYING THE RIGHTFUL PENSION TO JCOs & ORs
        The PDAs are initiating action to make OROP payments to the pensioners with necessary Dearness Relief.. No application is also required from the pensioners.
                                              

         All types of Family Pension will also be revised as given in the related tables attached. Since the Family pension is related to the Retiring Pension of the Pensioners the Family pensions will be regulated as per the Qualifying Service of the Pensioner, which is a new feature from the earlier instructions given in Circular No 500. This is because earlier that was the minimum guaranteed pension were as the OROP scheme is not based on minimum guaranteed scales.
\         All Majors who had retired after 21 years of service will be paid pension of LT COL.
           The arrears wef 01 Jul 2014 till date will be paid in full to all types of family pensioners and gallantry award winners where as to others it will be in four equal installments.
          The retiring pension of the Pensioners who retired after 01 Jan 2006 till 30 Jun 2014 will also be regulated as per OROP scheme. However in case they are already drawing more than the pension given in the related table will continue to get the higher pension.
          The PBORs will be given pension as per their maximum terms of engagements which have also been listed in the Circular No 555. The circular also includes the equivalent ranks in Navy and Air Force for easy of understanding by the PDAs. Similarly various groups have also been charted with equivalent groups in Navy and Air Force. ORs who have been granted ACP 1 or ACP ll will be paid the pension of higher rank.

11. The provisions of this circular shall be applicable to all Pre-01.07.2014 pensioners/family pensioners and their pension/family pension shall be stepped up with reference to rank, group and qualifying service in which they were pensioned.

Note: -a) The officers retired on or after 1.1.1996 in the rank of Major and who have completed 21 years of service have been allowed the pay of Lt.Col. Accordingly, pension of these officers have been revised by issue of Corr. PPOs. It is therefore, requested to revise the pension of post-96 Army Officer with rank Major and its equivalent in the Air Force and Navy who have completed 21 years

  1. If I could be explained what is the difference between actual service and qualifying service. I have in one of my Corr PPO mention that QS is 29 years but my actual service is 21 years. I had sought pre-mature retirement in the Rank of Sqn Ldr.
    For the purpose of OROP what is to be taken into account in the OROP Table for officers? QS or AS (Actual Service). Does the concept of weightage still exist. Which column should belooked into 21 or 29...regards

    There is an anomaly that will arise in respect of Technical Graduate Entry Officers granted Ante-Date Seniority. Ante-Date seniority counts for seniority, promotion and increments therefore in pension fixation based on last pay drawn, the ante-date seniority gets considered whereas in fixation under OROP, only the physical qualifying service gets considered which will be one increment less. All technical entry officers would be affected.

  3. Dear Col Menon,
    Kindly check your PPO ans see if the ante date is included in your QS mentioned there, it should have been. The QS is mentioned towards right side just below the name and average salary. It will be like QS 230811 meaning 23 years eight months and 11 days.
    Cir - 555 clearly indicates that it is the QS mentioned on PPO which will be taken by the PDAs in giving you OROP pension.

  4. Dear Sqn Ldr Chatterjee
    Your actual service will count for your pension. You get rank weightage to reduce your shortfall from 33 years to earn your full pension. A Lt Col (S) grade and Col (S) grade gets 7 years as rank weight-age. You took PMY after 21 years in the rank of Sqn Ldr. Your rank weight-age is 8 years. How ever your pension will be reflected at 21 years for Sqn Ldr.
    We at Tri Services Ex servicemen Welfare Association(TSEWA) are taking up a case to get such PMR officers their due full pension as Hon'ble SC and HCs have already quashed this rule of 33 years. Kindly contact me at 9650804787 for more details.

    Sir,

    Would like to clarify further. Technical graduates undergo one year training in IMA during which they are given short service commission on probation. This period gets counted in qualifying service however, ante-date seniority is of two years. in my case, date of commission was 08 Jun 85, date of joining academy 07 Aug 84 and Ante-date seniority wef 19 Jun 83. Qualifying service is reckoned from 07 Aug 84 but pay and promotions from 19 Jun 83.

    Therefore in the present implementation method based on Q.S. from 07 Aug 84, I stand to lose one increment. Not sure if this is only in my case....would welcome inputs from other technical entry officers if this justifies being taken up as an anomaly.

    Rule 17 (a) of the Pension Regulations for the Army, Part I (2008) defines Qualyfying Service for Pension and Gratuity to include Actual qualifying service rendered by the officer plus a weightage (in years) appropriate to the last rank held as indicated below subject to the total qualifying service including weightage not exceeding 33 years.

    The Concept of OROP even in its undiluted form is only a temporary quick fix for an out standing denial of rights of a soldier since 1973 . A compensation(deferred payment Pckage) for forced early retirement of a soldier . Even The Full OROP in the present context and the future context of 7CPC recommendation is not at all a proper deferred payment package(Pension package ) since it does not address all the variable in relation to a similarly placed central Government employee. A near solution to this kind of forced early retirement of a soldier (in the National interest of keeping its Military young) only can be resolved through either of the two methods viz (1)To compensate the forced early retirement , Pre-1973 , the soldier enjoyed additional 40% pension over his civilian counter part . This has to be brought back , and any soldier retiring today would get 90% of his RE(Reckonable emoluments) as Pension since the civilians get 50% (or) (2) There are 40 incremental levels for a civilian in the 7CPC Matrix where as for the soldier due to his peculiar Government forced early retirement has only 25 incremental levels. The 40 incremental levels available to the civilian should be compressed into 25 levels for soldiers where by his pay and pension levels bloats. It automatically means the 60 years of Age of retirement is suitably and scientifically compressed for the soldier where by his RE and also pension improves and offsets the handicap of Government forced early retirement .
    Unless one of these is done , all other fixes are temporary Simco-fixes used for beards which had to be done every morning or to be dynamically revised which will only lead to fuzzy solution always and every time . Therefore , there is a need for a proper solution to the problem of forced early retirement . Till then , enjoy the present dispensation for what ever reason they have given for .

    Now coming on to few issues in the MOD orders .Will basically touch up on the family pensioners specially about the Men :-
    .1. You and me are alive and enjoying the pension and the so called OROP. But ,there are few of our comrades who gave their life for this country and for us to be alive as a soldiering community to live with Izzat . Yes , I am talking about the young martyrs. The martyrs are young because ,it is a universal truth of profession of Arms . I want to talk about their widows and children in the Post OROP scenario. Sir , these unfortunate families were earlier given a package which was based on the max RE of the Rank where as with the OROP package in place , the table fixes in their actual QS in the Rank . In some cases the OROP amount is even lesser than what they are drawing now .Since their modus of QS working has changed , they will even be disadvantaged in the Post 7CPC scenario. The casualty pension should be considered the way it is defined in the PRA-2008, Circular 456,503 and not randomly like what has been done for them in this Langda OROP circular 555(which is based on the MOD letter of 03 feb ). SOME THING HAS TO BE QUICKLY DONE to remove this anomaly before others get the OROP in to their bank . Any pension package or OROP , these are the only category who deserve it first and always first .In nut shell all the privileges( i would call it as rights) granted to the casualty pensioners as a category (liberlised ,SFP,dependent ,liberalised wounded etc etc )-the staus quo as existing should be maintained even in this order issued and hope the powers that be are listening and a quick fix amendment is issued before others get their OROP money in to the bank . Let us not make it a habit to drag every thing to the courts for deliverance of natural justice guaranteed under the constitution. ……..Contd/-

    .2. One fails to understand the randomness happening in the Ordinary Family Pension . It goes without saying that since 2006 all the family pensioners were getting family pension based on the Rank and max QS .It continued beyond 24/09/2012 for officer families but for JCO/OR families , it was reverted back to actual QS .Now in this OROP letter every family is given pension proportionate to the actual QS . One fails to understand why this random ,changes are taking place when you have a PRA-2008,under revision AFRA-1961.NRA-1961 are the bibles for pensions being Pension Regulations . This point requires deliberate follow up by the Service HQs.

    The Actual QS , the QS with rank weightage etc is an amusing subject by itself as amusing as the permanently residing monkey brigades (the actual monkeys) around the buildings in Senabavans and south/North blocks and the hutments around . Why at all have a doubt on the Antedate seniority granted to B.Tech technical graduates ? They are notionally commissioned two years before and their Antedate is & must be QS ( as good as physical service ). When it comes to Doctors , no body has any doubt on the subject , but why then have this doubt for the Techies ?Their Ante date is Physical service .

    Going back to Col Menon's qry it is confirmed that qualifying service for the Tech Graduates is taken from the date of Joining the Academy. At IMA the stay before commission is only one year as such their QS is about a year more than their course mates who pass out together on the same date.

  12. QS For Tech Graduates,

    It is clarified that the ante date is not counted in QS for the Pension. For the Tech Graduates their QS is taken from the date of joining the Academy to the date of retirement. Since On joining the Tech Graduates are given Short service Commission which gets counted as QS. This period is about a year and is explained in this Blog site under Qualifying service.
    The ante date of two years is counted towards seniority for pay and promotion.
    As regards Doctors the QS is well explained in the Pension Regulations part-1.

    FEW DAYS BACK THERE WAS A MAIL IN WHICH WE HAD GIVEN DETAILS OF PENSION HIKES OF THE JCOs & ORs TO REST THE UNCALLED FOR PROPAGANDA THAT OROP WAS FOUGHT FOR BY THE ESMs FOR THE BENEFIT OF OFFRS ONLY. THIS IS TOTALLY WRONG. THE FACTS ARE EXPLAINED IN THE RELATED POSTS IN THIS SITE.
    THE CHART SHOWS THE PERCENTAGE HIKE IN PENSION FROM THE LEVEL OF BEGINNING 6th CPC TO THE OROP LEVEL. FOR ORs THE HIKES HAVE BEEN OVER 40% THE MAX GAINERS ARE NAIKS AT 68%, JCOS HIKE HAD BEEN OVER 25 % WHERE AS THE OFFICERS HIKE HAD BEEN AROUND 22%.
    PLEASE EXPLAIN TO THE JCOs AND ORs WHO MAY BE IN TOUCH WITH YOU TODAY THESE FACTS.
    LET US UNDERSTAND THAT OROP SCHEME IS NOT A PENSION HIKE SCHEME, IT IS TO BRING PENSION PARITY AMONG THE PAST AND PRESENT RETIREES. HENCE WE MUST CHECK THE OROP FIGURES WITH THE PENSION BEING RECEIVED BY POST-2006 RETIREES.

    She being a recent retiree of post 2006 during the 6 CPC her fixation of pension is given in her PPO which will be refixed first in OROP Scheme and then on implementation of the recommendations of 7th CPC.
    Her Dec 15 pension plus 14305 the commutation deduction that her basic pension as of today is 26988.
    On OROP as per tables given in PCDA Cir-555 iro MNS Offrs of the rank of Brig with over 33 yrs of QS her pension will be fixed at 27095, the hike being not much since she retired only a year earlier than the base year of OROP i.e 2013. 27095 will be payable wef 01 Jul 2014.
    The picture on 7th CPC will only be clear once Govt accepts the recommendations of the CPC and the report of the empowered committee set up to scan and recommend the recommendations. However as per current recommendations she will get pension of 69630 wef 01 Jan 2016 ,
    All these figures are the basic pension figures as such DR as applicable will be in addition.

    Pl give your pensions as received in your bank for the months of JUNE 2015 and DEC 2015, and also whether Lt Col (Selection Grade)or Time Scale. Your QS is 29.5 yrs as such you should be getting full basic pension of a Lt Col ie Rs 26265/- (In bank you should have received Rs 69024/- as Jan Pension)

    May I request you to clarify the meaning and applicability of the clause in OROP circular 555 " Major putting 21 years of service shall be considered for Lt. Col. pension".I have more than 33 years of service and took PMR as a SQN LDR,shall this clause apply to me for having put more than 21 years of service for consideration of pension as Lt. Col.

    Please clarify following:

    one veteran served air force for 9 years and retd as corporal in 1969. He was reservist for 6 years and finally retd in 1975 after completing total of 15 years of service (incl reservist).

    He got reservist pension since 1975 till date. Presently he is getting reservist pension of Rs 3500/- plust DA.

    My question is: IS HE ENTITLED FOR OROP or NOT? If yes, what is the authority?
