OROP SCHEME 2016 - ISSUES NOT ADDRESSED

           Govt has implemented the OROP Scheme as per their notification despite the Jantar Mantar Agitation. We do hope that the agitation will succeed to achieve its stand. However the Govt is likely to take itsd that it has already instituted one man Judicial Committee under Justice Reddy to study the  demands. 
         While all efforts continue,  there is also need to prepare our list of issues, anomalies and what must be corrected by the Govt on OROP. We thus will like to take a step in this dirction by requesting our readers to kindly put in their bit under the comments to this post what they feel must be added, amended or modified in the scheme, in other words your wish list of issues.
          We will have the same refined by the experts and pass on to the concerned organisation, which will take up the issues with justice Reddy.

1.  PCDA CIRCULAR  No, 555 IS INCOMPATIBLE WITH GOVT LETTER ON OROP.    http://www.indianmilitary.info/2016/02/some-pertinent-incongruities-in-orop.html 


 Some pertinent incongruities in the OROP tables and the Circular issued for implementation of OROP by the Principal Controller of Defence Accounts (Pensions)       The Circular, on its own, has added many ifs and buts to the parent Government of India/Ministry of Defence Letter dated 07 Nov 2015 on OROP. These additional clauses are not a part of the OROP Scheme as implemented vide the above letter of the Ministry.


PARA 11 (a)  OF THE CIRCULAR . (MAJORS WITH 21 YRS OF SERVICE)

a) The officers retired on or after 1.1.1996 in the rank of Major and who have completed
21 years of service have been allowed the pay of Lt.Col. Accordingly, pension of these officers have been revised by issue of Corr. PPOs. It is therefore, requested to revise the pension of post-96 Army Officer with rank Major and its equivalent in the Air Force and Navy who have completed 21 years.

      NOTE --  Here a doubt has occured whether 21 yrs is Commissioned service or qualifying service. Since this may be related to the grant of Time Scale Promotion to Majors on completion of 21 yrs of service during the 4th CPC, the service should be the Commissioned service. In any case PCDA(P) would have issued Corrg PPOs in their cases.


7 CPC

 Minimum Pension/family pension (10.1.24)(10.1.26):As per 7th CPC recommendations
revised minimum pension will be 50% of the minimum revised salary of Rs 18000/&
Family pension will be 30% of it i.e. Minimum Pension will now be =Rs 9000/PM & family
Pension=Rs5400/ . Sofar minimum pension &Family pension have been the same i.e.Rs3500/
if existing minimum family Pension of Rs 3500/ is multiplied by 2.57 fitment benefit it comes
toRs 8995/PM BPS request the empower committee of Secretaries to look into it and to
ensure that minimum pension & family Pension remain the same

  1. Para 11a of PCDA Pen circular 555states that Majors with 21 yrs. or more service who retired after 01.01.1996 will get Pension of
    Lt. Col. Thus basic definition of OROP has been violated. Request it may be highlighted that all Majors who have retired with 21 yrs. or more commissioned service irrespective of date of retirement be treated equally i.e. granted Lt. Col. Pension.
    It is confirmed that NO Major or eq. who retired Prior to 01.01.1996 has been issued Corr. PPO except court cases

After implementation of fifth pay commission the service required for Lt Col /(TS) was reduced to 20 years. vide Government of India MOD LETTER no 14/(1)/98/D/(AG) dated 14 Jan2000 and the same was implemented wef the same date whereas the same should have been implemented wef 1 Jan 1996 and hence all the Officers who retired in the rank of Maj on or after 1/1/96 and till 13 Jan 96 should be paid the pay of a Lt col.
    The same has also been ruled by the Supreme court of India on 1 Mar 16.For putting up to the one man commission. MAJ AIDAN SINGH (retd).

  5. The case of disparity in pension of pre-2004 MAJOR's was never taken from this platform. I do not understand the reason behind this matter. The officer having less than 21 years were continue in dis advantage due to new policies like pay band system in 6th CPC and time scale promotion of Lt Col after 2004.

    Sub:- For Addressing Anomalies on One Rank One Pension (OROP)
    Dear Sir,
    With due respect, I take this opportunity to submit the following for your kind consideration please
    Please refer to PCDA (pension) Allahabad circular no: 555 dated 04/02/2016 regarding implementation of OROP to defence pensioners. Para 11(a) provide that the officers retired in the rank of Major & Equal with 21 year service have been allowed the pay of Lt Col. But the same has not been implemented as per letter and spirit of the case. About length of service the OROP consider the qualify service only and not any other basis.
    The retired Pre-2004 Major’s have already suffered and harassed for anomaly of 6th pay commission and policy matter. They have served more than 13 years service, done the same duties and responsibilities where nowadays Lt Col are posted. Equal length of service and equal duties must be respected now.
    Presently, no officer in the rank of Major will be retired. Because all officer on completion of 13 year service will be promoted to Lt Col on time scale. But the officers Pre-2004 Retired Major’s are still suffering. How they will got the benefits of OROP when no officer in the rank of Major will be retired in future.
    In view of above it is requested that para 11 (a) of OROP may please be implemented at the earliest. The Pre-2004 retired Major’s & Equivalent officers must get the justice please.
